These Terms of Service ("Terms") govern your access to and use of the Medtrek Ambulance website, patient portal, online billing portal, online forms, and related online services (collectively, the "Site") operated by Medtrek Ambulance ("Medtrek," "we," "us," or "our").

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Site.

1. Eligibility

By using this Site, you represent that you are at least eighteen (18) years of age or are using the Site under the supervision or authorization of a parent, legal guardian, healthcare representative, or other individual legally authorized to act on your behalf.

If you use this Site on behalf of another individual, you represent that you have the legal authority to do so.

2. Not for Medical Emergencies

DO NOT USE THIS WEBSITE FOR MEDICAL EMERGENCIES.

If you believe you are experiencing a medical emergency, immediately call 911 or go to the nearest emergency department.

This Site is not monitored continuously for emergency requests.

Submitting a transport request, contact form, email, text message, or other electronic communication through the Site does not create an emergency dispatch or guarantee immediate transportation.

3. No Medical Advice

Information provided on this Site is intended solely for general informational purposes.

Nothing on this Site constitutes medical advice, diagnosis, treatment, or professional medical judgment.

Always seek the advice of your physician or another qualified healthcare provider regarding any medical condition or healthcare decision.

Never disregard professional medical advice or delay seeking treatment because of information obtained from this Site.

4. Transport Requests

Transport requests submitted through the Site are considered requests for service only.

A transport is not confirmed until accepted by Medtrek's dispatch personnel.

All transport services remain subject to:

  • Unit availability
  • Staffing availability
  • Medical necessity
  • Licensing requirements
  • Weather conditions
  • Safety considerations
  • Applicable federal, state, and local laws
  • Completion of required transport documentation and patient consents

Medtrek reserves the right to decline or reschedule transportation when appropriate for operational, medical, legal, or safety reasons.

5. Billing and Online Payments

The online billing portal allows patients and authorized representatives to review and pay outstanding invoices.

By submitting payment, you represent that:

  • You are authorized to use the selected payment method;
  • The payment information you provide is accurate;
  • You authorize Medtrek and its payment processor to charge the payment method for the amount submitted.

Payments are processed by secure third-party payment processors.

Medtrek does not store complete credit or debit card numbers on its own systems.

Insurance claims, Medicare, Medicaid, commercial insurance billing, adjustments, appeals, refunds, patient balances, and payment disputes are handled in accordance with applicable laws, payer requirements, and Medtrek billing policies.

Payment of a patient balance does not guarantee insurance reimbursement or alter coverage determinations made by insurance carriers.

6. SMS Communications

If you voluntarily opt in to receive SMS communications from Medtrek Ambulance, you agree to receive text messages relating to:

  • Transport scheduling
  • Appointment reminders
  • Billing notifications
  • Account verification
  • Customer support
  • Other operational communications related to our services

Participation in SMS messaging is also governed by our SMS Messaging Privacy Policy and SMS Terms & Conditions.

7. User Accounts

Certain portions of the Site may require registration.

  • Promptly notifying Medtrek of any unauthorized access or suspected security breach.

Medtrek reserves the right to suspend or terminate accounts that violate these Terms or present security concerns.

You agree that you will not:

  • Submit false, misleading, or fraudulent information;
  • Attempt to access information belonging to another individual without authorization;
  • Interfere with the operation or security of the Site;
  • Introduce malware, viruses, ransomware, or other malicious software;
  • Attempt to gain unauthorized access to systems or networks;
  • Use automated software, bots, scripts, or scraping tools to collect Site data;
  • Reverse engineer, copy, or exploit any portion of the Site or its software;
  • Use the Site in a manner that could damage Medtrek or interfere with other users.

Medtrek is not responsible for the availability, privacy practices, or content of third-party services not owned or controlled by Medtrek.

11. Intellectual Property

All content available on the Site—including software, source code, databases, workflows, graphics, logos, icons, photographs, videos, documents, trademarks, service marks, trade dress, and other materials—is owned by Medtrek Ambulance or its licensors and is protected by United States intellectual property laws.

No portion of the Site may be copied, reproduced, distributed, modified, published, reverse engineered, or exploited without Medtrek's prior written permission except as expressly permitted by law.

Nothing in this section limits Medtrek's obligations regarding actual medical transportation services where such limitation is prohibited by law.

14. Limitation of Liability

To the fullest extent permitted by law, Medtrek Ambulance shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to your use of the Site.

This limitation applies solely to the website and related online services and does not limit liability for healthcare services where such limitation is prohibited by applicable law.

15. Force Majeure

Medtrek shall not be responsible for delays or failures resulting from causes beyond its reasonable control, including natural disasters, hurricanes, severe weather, pandemics, public health emergencies, labor disputes, cyberattacks, internet outages, power failures, governmental actions, acts of terrorism, civil disturbances, or other events beyond its reasonable control.

16. Suspension or Termination

Medtrek may suspend, restrict, or terminate access to the Site at any time if it reasonably believes:

  • These Terms have been violated;
  • Unauthorized access has occurred;
  • Continued access presents a security risk;
  • Suspension is necessary to protect patients, users, employees, or Medtrek systems.

17. Governing Law and Venue

These Terms shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any legal action arising from these Terms or your use of the Site shall be brought exclusively in the appropriate state or federal court having jurisdiction over Collier County, Florida, unless applicable law provides otherwise.

18. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

19. No Waiver

Failure by Medtrek to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

20. Assignment

You may not assign or transfer your rights or obligations under these Terms without Medtrek's prior written consent.

Medtrek may assign these Terms in connection with a merger, acquisition, sale of assets, corporate restructuring, or other business transaction.

21. Changes to These Terms

Medtrek reserves the right to modify these Terms at any time.

Updated Terms become effective immediately upon posting to the Site unless otherwise stated.

Your continued use of the Site after revised Terms are posted constitutes your acceptance of the updated Terms.

22. Entire Agreement

These Terms, together with our Privacy Policy, Notice of Privacy Practices, SMS Messaging Privacy Policy, and SMS Terms & Conditions, constitute the complete agreement governing your use of the Site and supersede all prior understandings relating to the Site.
